Million Siabutu (39) pleaded not guilty to the assault charge when he appeared before Binga resident magistrate Stephen Ndlovu on Friday.

The magistrate remanded him out of custody to June 14 for judgment.

Prosecutor Bruce Maphosa told the court that on December 23 last year at 5pm, the complainant Luckson Muleya was drinking beer with his younger brother at a bottle store in Nsinampongo.

Siabutu arrived and allegedly pushed Muleya against the wall. Muleya allegedly responded by slapping him on the face.

Siabutu allegedly ran back to his home where he armed himself with an axe.

He struck Muleya on the left leg and right thigh with the axe.

A report made to the police led to Siabutu’s arrest.

In denying the charge Siabutu said: “I was defending myself because they were attacking me.”

Siabutu had a gush on the head which he claimed was caused by the complainant who hit him with a stone during the scuffle.

He brought his defence witness Patrick Mwinde who testified that Muleya and his brother were the ones who attacked Siabutu with bricks and the injuries on his head were enough evidence that he was a victim of the attack.
