High Court judge Justice Lawrence Kamocha last week found Noel Nkomo guilty of murder with constructive intent.

Nkomo of Makusha Township heavily assaulted his late wife Grace Zulu after an argument ensued over a phone call she had received on her mobile.

He kicked his wife with booted feet, hit her with fists and banged her head against the wall before she collapsed and subsequently died from head injuries and a fractured skull.

In passing sentence, Justice Kamocha said homes should never be turned into war zones where people ended up being killed.

The judge said had it not been for the one year the businessman spent in remand prison, a jail term above 20 years would have been proper.

Prosecuting, chief law officer Rosa Takuva told the court that on October 13 2010, Nkomo had a argument with his wife over a phone call she had received from another man, whom he suspected was having an affair with his wife.

At around 9pm on the same day the accused locked all the doors to the house including that of the bedroom.

Nkomo turned loud the volume of music on the radio and started assaulting his wife with fists, booted feet and banged her head against the wall.

At around 11pm the businessman’s younger brother, Sergeant Nkomo knocked on the bedroom door.

Nkomo opened and told his brother he had been fighting with his wife, but said he did not know what had happened to her as she lay on the bed breathing heavily. The brother advised him to take her to hospital, but he said he would do that the following morning and also hand himself to the police.

On October 14 2010 at around 6am, Nkomo took his wife to Shurugwi General Hospital where she was pronounced dead.

He took her body back home and left it in the bedroom floor before disappearing.

His brother reported the matter to the police, leading to Nkomo’s arrest on July 13 the following year in Kwekwe.
