Harare magistrate Donald Ndirowei remanded Rushwaya in custody to November 14 when he would be furnished with his trial date.

Prosecutor Tungamirai Chakurira alleged that on October 28, Rushwaya, who resides in Damofalls, arrived home from the beerhall, unlocked the door and entered into the house before proceeding to the kitchen where the complainant was asleep. The court heard that the accused person, who was holding a baton stick, allegedly ordered the complainant to remain silent and threatened to kill her if she screamed.

The accused is alleged to have pulled up the teenager’s skirt to waist level and removed her undergarments before stripping off his own trousers. He then allegedly raped the complainant once.

Afterwards, the court heard, he advised the complainant not to be afraid before threatening her with death if she told anyone what had transpired. He is alleged to have dressed and left the room. The following day, Rushwaya allegedly accused the complainant of stealing his $20. He allegedly threatened the complainant again with death if she reported the matter to his wife.

The complainant is reported to have fled from home and phoned her brother telling him what had transpired. On October 30, a report was made at Ruwa Police Station leading to Rushwaya’s arrest.
