A Gwanda woman was yesterday spared the agony of jail life after receiving a wholly suspended sentence for ambushing her polygamist husband whom she struck with a log fracturing his right arm.

The husband ran for dear life stark naked. Jane Malunga (73) of Zhukwe village under Chief Masuku was convicted by Gwanda magistrate Sheila Nazombe on charges of physical abuse and was sentenced to six months in prison which was wholly suspended for five years on condition she does not commit a similar offence within the same period.

Malunga told the court that she had assaulted her husband Nickson Lumbimbi after he had indicated to her that he wanted to marry a fifth wife, but she was against it because the woman in question is HIV-positive.

State prosecutor Mncedisi Dube said on September at around 2pm, Malunga took a wooden log from the garden and assaulted Lumbimbi leaving him with a fractured right hand.

Malunga said her husband of almost 20 years was involved in an extra-marital affair with an HIV-positive woman and intended marrying her as his fifth wife and, she had assaulted Lumbimbi to prevent him seeing the woman.

Lumbimbi, who had a plaster on his right hand, said he was a registered polygamist with four wives and had notified Malunga and his in-laws of his intention to marry a fifth wife.

He said he was forced to run naked around the garden with his wife in hot pursuit during the assault.

In mitigation, Malunga pleaded for leniency saying she was diabetic and also suffered from high blood pressure.

Nazombe lashed out at Malunga for her violent behaviour saying she should be exemplary in society as a senior citizen.

“You armed yourself with a log and struck your husband while he was bathing causing a dramatic scene as he had to run around naked in broad daylight. You should be ashamed of yourself; change and behave normally.

“Young couples should be coming to you with their marital problems instead of you coming to court,” Nazombe said.
