SILAS NKALA STAFF REPORTER Mutsindikwa told the inquest into Mgura’s death being presided over by Bulawayo magistrate Gladmore Mushove, that the docket should have been given to pathologist Sanganai Pesanayi to enable him to prepare for cross examination by the deceased’s relatives.

Mgura of Emganwini high-density suburb who was disabled and diabetic, died at sex worker Belinda Chikerema (29)’s Yolanda Flats along Robert Mugabe Way between Connaught and Masotsha Ndlovu avenues after an alleged night of passion.

Pesanayi performed a post mortem on Mgura’s body and testified at the inquest on July 23, but the court remanded the case after his relatives indicated that they wanted to question the pathologist.

Pesanayi told the inquiry that Mgura died due to internal bleeding into the brain and a stroke.

After numerous queries over the authenticity of his post mortem by Mgura’s uncle, Pesanayi said the body could be exhumed and parts be taken to South Africa for further tests if the relatives were not satisfied.

Mgura’s relatives were angry on Wednesday when Mutsindikwa told them they could not proceed as Pesanayi was not able to attend because the police failed to serve him with the docket for further cross examination.

“May this matter be remanded to September 3 because the doctor who is supposed to testify has not come.

“The docket was sent to the police to serve him, but it appears they have not served him.

“We are failing to locate the docket at the police and it appears the doctor has not been served with the papers,” Mutsindikwa told the court.

Mushove consented and remanded the case to September 3.

Mgura’s wife Lizzy Lunga and relatives suspect that he was drugged before semen was extracted from him resulting in his death.

Mgura walked with the aid of crutches as his left leg was amputated due to diabetes.

Chikerema gave the police conflicting statements in the aftermath of the death last year.

In one of her statements, she claimed that they had picked Mgura up at a bus stop when they found him lying in a drunken stupor while accompanying their aunt to look for transport.

She then changed and said Mgura had hired her for sex from a city bar.
