This came to light when the man appeared before the Western Commonage provincial magistrate Willard Mafios Moyo, facing rape charges as defined by Section 65 of the CriminalLaw (Codification and Reform) Act.

He pleaded not guilty to the charge and claimed he only fondled her so she could sweep his room.

“I only fondled her trying to make her smile so that she could agree to sweep my bedroom,” he said in his defence.

He was remanded in custody to January 21 for trial.

Agreed facts are that the uncle met his niece on her way from church and asked if there was anyone at home and she said there was no one.

The two then went home together and upon noticing there was no one in the house, the uncle took advantage of the situation and asked the niece to sweep his room and offered her mangoes in return.

The girl took a broom and went straight to the room where she was later grabbed by the waist, thrown onto the bed and raped once.

According to the girl, she failed to cry out for help fearing her uncle might end up doing more than just raping her.

“I was scared that he (uncle) might end up stabbing me or strangling me to death so I kept quiet until he was done,” she said.

“Soon after he left, I ran back to church to tell my mother what had happened.”

Testifying in court, the mother said she saw her daughter coming to church in tears and thought she was hungry because she had not cooked anything for her.

“She explained what transpired and I immediately took her home, inspected her and reported the matter to the police,” she said.

The uncle then went on the run from that day and the police launched a manhunt for him.

He was found at a bar in the suburb.
