Ishmael Zibula of Njube suburb in Bulawayo appeared before the Western Commonage provincial magistrate Willard Mafios Moyo, where he was charged for contravening Section 70 of the Criminal Law (Codification and Reform) Act and was not asked to plead.
He was remanded out of custody on free bail to February 5 for plea recording. Zibula told the court he was not aware that the girl was a minor, as she did not mention anything to him before she accepted his proposal.
“She never told me she was underage, but she accepted my proposal,” he said.
“I visited her often and we would take walks and sit at a nearby bush and make love.”
Agreed facts are that last November, Zibula met the girl and proposed love to her and she agreed, leading to him making regular visits to the girl’s home.
Zibula is said to have visited the girl each time he was off duty and took her to a nearby bush, in an area known as O Square in Njube.

The two had sexual intercourse without a condom several times until the juvenile fell pregnant.
The girl realised she was pregnant and sent the soldier a text message which was intercepted by her sister, who took her for a medical check-up at Mpilo Central Hospital.
Her pregnancy was confirmed and a report was made to the police, leading to the soldier’s arrest.
“I was disappointed to discover that my sister was pregnant at such a tender age due to a shameful adult who does not know how to control his feelings,” the girl’s sister said.
