Client Hwanda (26) of Lupane Compound pleaded not guilty to the assault charge when he appeared before Lupane resident magistrate Aelene Munamati.

But after a full trial, the magistrate convicted and sentenced him to pay a fine of $300 or serve three months in jail.

Prosecutor Wilberforce Ngoshi told the court that on February 1 this year at 9pm, the police officer, Lovedany Madambi, residing at Lupane Police Camp and a detective attached to Lupane Criminal Investigations Department Law and Order Section was at Wise Waters bottle store at Lupane business centre.

He decided to get out of the pub to refresh himself and Hwanda, who was inside the pub, followed him.

It is the State’s case that Hwanda grabbed Madambi and advised him that he wanted to assault him since he was on the CIO wanted list.

He allegedly started assaulting him with fists and kicked him several times all over his body.

Madambi struggled to free himself from Hwanda’s grip before he managed to escape.

He sustained bruises on the face and he was treated at St Luke’s Hospital.
