Jealous Tshuma pleaded not guilty to charges of malicious damage to property when he appeared before Gwanda magistrate Sheila Nazombe, but was convicted due to “overwhelming evidence”.

However, Tshuma will spend two years in prison if he pays the complainant $1 752, the cost of the damaged property.

In sentencing Tshuma, Nazombe said she had taken into cognisance that the offence was premeditated.

The court was told that last Saturday at around 4pm, Tshuma went to the house of his ex-wife Nokuthula Masuku’s new lover Dominic Sithole.

Upon arrival, he demanded property which he said Masuku had taken with her when they divorced.

She gave him the property, but failed to give him $60 promising to pay him when Sithole got paid.

Tshuma went away, but returned later under the cover of darkness at around 8pm and picked up stones which he hurled at the couple’s house smashing the windows. Sithole and Masuku fled the house and stood at a distance and identified Tshuma as the attacker when a passing vehicle flashed its lights on him.

Tshuma then set alight household goods which included furniture and clothing resulting in the roof of the house being destroyed as well. The total cost of the damage was pegged at $1 752.
