A 37-YEAR-OLD man from Old Pumula suburb is in court facing indecent assault and unlawful detention charges after he allegedly took advantage of a drunk minor and persuaded her to spend a night at his home.

The man, Norman Moyo, appeared yesterday before Western Commonage magistrate Tancy Chipumha Dube, where he was not asked to plead, as his charge was set to be altered to rape after the police received a medical report confirming that the 14-year-old had been raped.

Moyo was remanded in custody to January 30 for plea recording.

In his statement to the police, Moyo denied sleeping or fondling the minor, saying she had been persuaded to frame him.

Prosecutor Kenneth Shava told the court that the man reportedly went to his friend’s home residence and they drank beer before calling the tenant’s daughter to join in and drink with them.

As the girl got drunk, she spotted her aunt, before running away to hide behind a nearby bush, where she was found by an unidentified elderly man, who threatened to take her to the police camp.

The girl then decided to return home and on her way, she met Moyo, whom she had been drinking beer with earlier.

Moyo persuaded the girl to go with him to his house, claiming he stayed with his sister, whom she would share a bed with overnight.

“I believed his word and went with him, however, along the way he started fondling me, but I told him to stop and he did,” she said.

“Upon arrival, I never saw any sign of a woman staying in the house, I asked him but he did not respond.

“He took out beers and we drank until I dozed off,” she added.

In the morning when she awoke, the girl said she felt pain in her private parts, but could not claim she had been raped, as she could not remember Moyo forcing himself on her.

The girl’s aunt, who had spent the night looking for her, made a report to the police that she was missing.
