Man jailed 8 years for killing drinking buddy

A MAN from Tsholotsho was yesterday slapped with eight years in jail after he stoned to death a drinking mate for calling him a “boy”. Khulekani Moyo (35) pleaded not guilty to murder when he appeared before Bulawayo High Court judge Justice Nokuthula Moyo during a circuit court at Hwange Courts yesterday, but admitted to the culpable homicide charge.

Moyo sentenced him to eight years in jail.

In passing sentence, the judge said while the deceased was the aggressor, the court must not lose sight of the fact that the accused used a lethal weapon, a stone.

“Thus, a light sentence will trivialise the offence as a life was lost,” Justice Moyo ruled.

Agreed facts between the State, represented by Charlene Gorerino, and Moyo’s lawyer, Givemore Muvhiringi, were that Moyo, 34 then, and the now deceased, Buzani Moyo (28), were coming from a beer drink with Agent Ndlovu and Geneva Sibanda at Dugwi business centre in Tsholotsho on May 14, 2015 at 10pm.

Along the way, Moyo had an argument with Buzani after he called them boys.

Moyo told Buzani that he was being disrespectful and went on to slap him.

Moyo also picked up a stone and struck Buzani with it.

He hit him on the right jaw and he fell down and died.

Moyo left the body lying on the ground and went home.

In court, through his lawyer, he admitted he caused Buzani’s death through negligently attacking him with a stone, but said it was not his intention to kill him.

He also indicated that Buzani was the aggressor and he felt provoked.
