A WOMAN from Lobengula suburb in Bulawayo allegedly lied to the assistant master of the High Court with the help of three residents in order to obtain authoritative status on the estates of her late husband.
SILAS NKALA STAFF REPORTER
Sithembiso Phiri (45), who was a second wife, appeared before Bulawayo magistrate Gladmore Mushove alongside her accomplices Elias Mlotshwa (67) Modecai Mlotshwa (71) and Gladman Masuku (59) all of Njube.
They were not asked to plead to a charge of fraud and were remanded out of custody to January 13.
The court heard that Phiri was customarily married to the deceased while the complainant Rhodah Hlongwane was legally married to him.
It is the State’s case that Elias, Modecai and Masuku, who are not related to the deceased in any way, approached the assistant master of the High Court and testified that the deceased had only one surviving wife Phiri, yet they knew that Hlongwane was still alive.
Acting on the misrepresentation of the three, the assistant master of the High Court granted authority to Phiri over the deceased’s estates.
The offence came to light when Hlongwane’s relatives and the deceased’s brothers applied for a death certificate.
