Appearing before Victoria Falls resident magistrate Sharon Rosemani was a building constructor — Tawanda Mushonga (28) of house number 2841 Chinotimba Township — was convicted of two counts of Contravening Section 13 of the Criminal Law (Codification and Reform ) Act, Chapter 9:28 “theft”.

Rosemani sentenced Mushonga to restitute 1 300 building bricks or three months in prison on the first count.

On the second count, he was sentenced to perform 105 hours of community service.

However, Mushonga’s co-accused’s and employees Oscar Nyamundira (22) and Derrick Sibanda (34) both residing at house number 4126 Chinotimba pleaded not guilty to the same charges.

Rosemani then separated the trial and remanded the duo out of custody to March 5 for trial.

Nyamundira and Sibanda denied stealing the bricks arguing that they were employees working under instruction from Mushonga.

“We didn’t know he was stealing those bricks we were only told to go and collect them at different stands and we thought he had bought them,” said Nyamindira.

For the state, prosecutor David Tivakudze said sometime in 2011 Shelton Tari of house number 7905 Mkhosana Township moulded some bricks for the construction of his house.

In February this year Mushonga with the aid of Nyamundira and Sibanda went and stole the 1 500 bricks which were valued at $1 800 and only $744 was recovered.

On February 17 this year the again went and stole 300 bricks of an unknown person to the court. The three at around 3am were spotted by police officers on patrol in Chinotimba township loading bricks into a truck, leading to their arrest.
