Nomalanga Phangwana (29) of Gumtree said her ex-husband Ellias Mwale (35) of Mzilikazi was ordered to pay her $50 per month in maintenance for the upkeep of their six-year-old son, but he had only made two payments since February last year.

“I took Mwale to court in February last year because he was failing to provide for his son’s needs and the court ordered him to pay $50 monthly, but he has gone for eight months without paying maintenance,” Phangwana said.

“His son has gone for three terms without paying school fees and this term the head of the school that he attends has warned me against sending the child to school without paying fees.”

She said Mwale was in the business of selling electrical gadgets such as decoders and television sets and had no excuse for non-payment.

Phangwana said she was unemployed and earned a living by selling chickens and the money she made only enabled her to buy food. She alleged that Mwale was failing to pay maintenance yet he was renting a flat for his lover.

“He is failing to pay maintenance for our son because he is renting a flat for his lover in town. I have even approached his lover and she confirmed that Mwale is taking care of her at the expense of our son,” Phangwana said.

She said Mwale does not answer his phone whenever she calls him and has now reported him to the police.

Mwale denied that he owed Phangwana $400 saying he owed her $200 and had not been paying her because she does not have a bank account.

“The reason why I have not been paying her is because I once paid her and she claimed I did not until the court said I should start depositing the money into the bank. If she opens an account, I will pay,” he said.
