Khululani Ncube pleaded not guilty to murder and was convicted of a lesser charge of culpable homicide when he appeared before High Court judge Justice Nokuthula Moyo at the Hwange High Court Circuit yesterday.

Prosecutor Matirai Ngwasha said on December 10 2013 at around 7pm, Khululani and Jayson Ncube (29) were drinking beer at Bhulani bottle store at Gwitshi business centre.

Khululani asked for some mbanje from Jayson who refused resulting in the former punching the latter.

Jayson retaliated, but the two were restrained. It was alleged that Khululani picked up a half brick and struck the now-deceased once on the forehead and he fell down unconscious.

Khululani fled the scene and Jayson was carried to his homestead where he died.

Through his defence counsel Givemore Muvhiringi of Dube and Company, Khululani pleaded for a lesser charge and a sentence of between four and five years because he did not intend to kill Jayson and the fight had been fuelled by alcohol.

Justice Moyo agreed, but said it was still a very serious offence and sentenced him to 10 years in prison. Three were suspended on condition of good behaviour.
