Peter Ndlovu of Collen Bawn had pleaded not guilty, but was convicted by Gwanda magistrate Olivia Mashava Mashaire due to overwhelming evidence.

Ndlovu was, however, lucky to escape prison life after the three months in prison term was wholly suspended on condition he does not commit a similar offence within the next five years.

In mitigation, Ndlovu pleaded for leniency saying he is HIV-positive and was on anti-retroviral drugs hence sending him to jail would worsen his health condition.

The court heard that last Saturday at around 8pm, Ndlovu took Stechling Branden Leigh Thursin (19) and his wife Natalie Gillgower (31) from Horse Shoe Mine in Collen Bawn for a binge at the local bar.

Gillgower said Ndlovu bought half a litre of Nikolai Vodka and some cokes. She told the court that while they were drinking, Ndlovu said the brew was too weak and suggested that they add more Vodka.

She said they drank until way past midnight and as they were leaving, Ndlovu gave Thursin some money to buy himself two quarts of Black Label.
