The accused, who cannot be named to protect the identity of the complainant, chased his niece and tripped her to the ground before prematurely ejaculating on the juvenile’s private parts.

Regional magistrate, Colet Ncube ruled that a medical examination saved the man from the initial rape charge he was accused of as it showed that no penetration had occurred.

Ncube, however, said that the girl’s testimony in court was credible, as she consistently maintained that the accused had forced himself on her.

The accused was initially sentenced to six years in prison, but two years were suspended for five years on condition of good behaviour.

In coming up with the sentence Ncube also said he considered that the case had taken long to be completed.

The State’s case was that on July 6 2009 at 4pm, the accused met the complainant at the grazing land where he asked her to come to him.

When the complainant refused, the accused chased her, caught up with her and tripped her to the ground and forcibly kissed her.

The complainant went on to notify a neighbour who was also herding his cattle about the incident before a report was made to the police, leading to the arrest of the accused.
