THE HIGH Court of Zimbabwe has dismissed preliminary objections raised by a police constable challenging dismissal from the Zimbabwe Republic Police (ZRP).
In his chamber application, Constable Wellington Chadenga was seeking a stay to dismissal from the police service.
Justice Maxwell Takuva presided over the matter.
Chadenga cited Chief Superintendent Naison Hambira and Police Commissioner-General as respondents.
The notices of opposition filed by the respondents, led by Hambira and the Police Commissioner-General, were deemed valid.
The respondents’ notices of opposition were accepted by the court, which determined that the deviation from the standard format did not invalidate the proceedings.
The matter will now proceed to a full hearing on its merits.
The case revolves around Chadenga’s conviction and sentence to 14 days imprisonment in January 2024.

He subsequently appealed the decision and applied for a review, challenging the rulings made by the first and second respondents.
Chadenga’s legal team contended that the respondents’ decision to dismiss him from the police service was being pursued without regard to the pending court applications.
The court’s decision allows the matter to move forward, providing an opportunity for a comprehensive examination of the case and ensuring that all parties have a chance to present their arguments.
