This came to light when the accused, Gcinani Dlomo, appeared before Matebeleland North Provincial Magistrate Ndumo Masuku facing a charge of contravening Section 65 of the Criminal Law (Codification and Reform) Act Chapter 9:23.
He pleaded not guilty and was remanded out of custody until the matter was transferred to Bulawayo Magistrates’ Courts.
The State established that on an unknown date, sometime last year, the accused went to a bedroom hut where the complainant and her friend were playing.
The accused allegedly closed the door and immediately removed his trousers, ordering the complainant’s friend to lie down and remove her undergarments.
The complainant tried to run away, but Dlomo allegedly stopped her and warned her that he would assault her if she tried to escape again.
Dlomo then tried to rape the complainant’s friend, but she screamed and managed to escape. The accused then grabbed the nine-year-old and raped her once.
