Kombi driver jailed for killing pedestrian

Kelvin Mhasi was arraigned before Harare magistrate Apollonia Marutya charged with culpable homicide and pleaded not guilty during the trial.

A 26-YEAR-OLD commuter omnibus driver from Hatcliffe has been convicted and sentenced to an effective 17 months in jail for culpable homicide.

Kelvin Mhasi was arraigned before Harare magistrate Apollonia Marutya charged with culpable homicide and pleaded not guilty during the trial.

However, prosecutor Farai Makuyana proved beyond doubt that Mhasi was travelling at an excessive speed in the circumstances.

Makuyana, during trial, told the court that on September 12, 2024, Mhasi was driving a Toyota Hiace in Harare due east along Fife Avenue and at the same time the deceased Slyvester Koniki was crossing the road due South.

The court heard that Mhasi hit Koniki who succumbed to injuries sustained due to the accident and died on the spot.

Mhasi stopped at the accident scene and Koniki was taken to Parirenyatwa Hospital where a postmortem was done.

Makuyana proved that Mhasi was negligent because he failed to keep a proper lookout on the road and also failed to stop or act reasonably when the collision seemed imminent.
