BULAWAYO, Jul 20, (Southern Eye Live) -A 37-year-old man from Nkayi, whose name was withheld to protect the image of the complainant, has been acquitted on a charge of raping his ex-wife.
Prosecutor Nomathandazo Mafu noted the numerous inconsistencies in the State's case, leading to the acquittal.
“There were serious discrepancies in the evidence from both witnesses. The complainant said she separated from the accused in March, while the second witness said it was January, raising questions about the timelines. There were also conflicting accounts of what happened after the alleged incident, and the second witness admitted to having lied in her statements," said Mafu.
"What completely destroys the State’s case is the second witness’s confession that she lied. The state has no choice but to do the right thing," added Mafu.
