This came to light when the accused, Onias Mpofu, appeared before Bulawayo magistrate Crispen Mberewere facing charges of contravening Section 65(1)(a) of the Criminal Law (Codification and Reform) Act Chapter 9:23.
He pleaded not guilty, arguing that he had promised to pay her $3 for sexual intercourse. He was remanded in custody to November 7. “I did not rape her, we had sex,” he told the court.
“I had promised to give her $3 for the act, but trouble arose after I gave her R5 since I could no longer find the $3 I had on me.”
For the State, Trust Muduma told the court that on October 30, a 25-year-old woman (name withheld) was seated at the entrance of Gijima Night Club on Herbet Chitepo between 3rd and 4th Avenues in Bulawayo when the accused told her that her boyfriend was waiting for her at Cemetery Park and wanted to give her some food.
The complainant and the accused went to the squatter camp at Cemetery Park and found the complainant’s boyfriend not there.
