The man, who cannot be named to protect the identity of the complainant, went to his mother’s home in Mkoba 16 where the girl was staying and took her and her little brother to his place in Mkoba 6. The accused then took the girl to his bedroom where he raped her once.

Regional magistrate Morgan Nemadire initially sentenced the man to 12 years, but suspended three years for five years on condition of good behaviour.

The State’s case was that on February 8, the accused took his daughter and her little brother from the siblings’ grandmother.

When they arrived at his place in Mkoba 6, the children started playing outside, but the girl got inside the house some few minutes later.

The accused took the minor to his bedroom where he removed her undergarments and laid her on his bed before raping her once. After some few hours, he took the kids back to their grandmother, but insisted he wanted to go back with his daughter since she was not attending school, but the girl refused.

On February 9, the girl’s grandmother wanted to cut her toe nails, but she refused, saying she would bleed from her privates as happened at her father’s house.

The grandmother examined the girl’s private parts and discovered reddish marks. A report was made to the police leading to the accused’s arrest.
