Frustration as Freddy fails to appear in court again

Freddy claims the land was donated to him by Taruberekera in 2016, but the property developer revoked the donation in 2021, citing unmet conditions.

For the 10th time self-styled prophet Tapiwa Freddy has not set his foot at the Kadoma magistrate’s court where he is a key witness in a case involving property developer Kudakwashe Taruberekera whom he is accusing of illegally revoking a deed donation.

Last Tuesday Taruberekera was the sole party present in court as the matter was postponed yet again to July 4 by magistrate Yeukai Dzuda.

The case revolves around Stand Number 7510, Mandalay of Sabonabona in Kadoma a 4 000 square metre property.

Freddy claims the land was donated to him by Taruberekera in 2016, but the property developer revoked the donation in 2021, citing unmet conditions.

Since the matter first appeared in court in February 2025, it has been repeatedly postponed.

Despite being the complainant, Freddy has not been appearing at the Kadoma magistrate’s court, raising eyebrows on the other hand.

“It appears the matter is being strategically dragged to wear down our client, who has consistently complied with court appearances while the complainant has shown complete disregard for the legal process,” said Simon Musapatika, Tarubereka’s legal representative from Danziger and Partners Legal Practitioners.

Musapatika also raised concerns about the slow pace in obtaining a letter from the Kadoma City Council, which the state claims is key to proceeding with the trial.

“How it takes over two months to get a simple letter is beyond comprehension,” he said.

Taruberekera maintains that the case is a civil dispute and that Freddy’s involvement of the Zimbabwe Anti-Corruption Commission (Zacc) was an abuse of legal channels meant to intimidate him and his company, Craft Properties.

“The involvement of Zacc was an act of malice,” Taruberekera said in an affidavit.

“If the donation was truly valid, the complainant should have approached Craft Properties directly instead of escalating it through anti-corruption authorities.”

Taruberekera expressed frustration over the delays, saying his company; Craft Properties, was incurring heavy costs and business disruptions.
