Bukhosi Sithole of X Square, Mzilikazi, whose age was not given, appeared in court on Wednesday facing a robbery charge as defined under Section 126 (1) (a) of the Criminal Law (Codification and Reform) Act Chapter 9:23.

Prosecutor Marlvin Nzombe told the court that on the evening of May 14, Sithole and an accomplice — still at large — met the complainant Sindiso Mlalazi in Mzilikazi suburb.

The complainant was on his way home from night school.

“The complainant spotted the accused in the company of another man, who is still at large, standing near the school gate,” Nzombe said.

“The two accused persons then started following the complainant, overtook him and later turned and approached him. “Sithole then grabbed the complainant by the neck while his accomplice searched his pockets.”

Nzombe said the two then stole from the complainant a Nokia C3 cellphone and went away.

“The complainant, however, managed to identify Sithole, as he had met him several times in the same suburb,” the State said.

“He made a police report and the accused was arrested and positively identified by the complainant as the one who had robbed him.”

Nzombe said the phone was not recovered.

Magistrate Witness Mtetwa remanded Sithole in custody to July 3 for trial.
