TWO Binga men were on Monday sentenced to eight years in prison for fatally assaulting a 61-year-old villager at a beer drink.

Million Munga (51) and Obert Muleya (39) of Munkombwe village under Chief Pashu pleaded not guilty to murder, but were convicted of a lesser charge of culpable homicide when they appeared before Bulawayo High Court judge Justice Nokuthula Moyo sitting at the Hwange High Court Circuit.

The pro deo lawyer for the two, Vuyile Mpofu of Cheda and Partners, pleaded with the court saying his clients were family men with minor children to look after. Mpofu said the two were relatively drunk when they committed the offence as they had started drinking from 8am till evening and did not know what they were doing when they killed Jairos Chabwe Muleya. They had accused Jairos of interfering in their fight with his son Tom.

For the State, Whisper Mabhaudi said on August 26 2013 Munga, Obert and headman Munkombwe, who is now deceased, were at a traditional ceremony at Muntania Mufwakuchela’s homestead where they were drinking beer. The two had a misunderstanding with Jairos’ son Tom and he intervened to restrain them from assaulting him.

However, Munga and Munkombwe turned on Jairos.
