The boy from Village 1 in Cement Siding was doing Form 4 at Eastview High School in Mahatshula in October last year when he became intimate with the girl in a toilet.

He was accused of plying the Form 2 girl with alcohol before dragging her to a toilet.

The girl said she suspected the alcohol was spiked as she fell into a deep slumber after consuming it.

She said the boy dragged her into a toilet where he raped her and she saw a used condom next to her after she woke up.

However, the boy claimed the sex was consensual and he never drugged the girl.

“I did not rape her, we had sex after she consented to it and I never dragged her to the toilet,” he said.

Bulawayo regional magistrate Mark Dzira convicted him for the lesser offence and the sentence was suspended for five years on condition of good behaviour.

Prosecutor Tinashe Dzipe had told the court that the girl, who was a boarder at Eastview, approached a senior teacher with three other girls requesting for permission to attend the party on October 11 2013.

The teacher reportedly referred the four girls to the school’s headmaster who approved their exit passes.

The passes were processed and handed to the school matron who gave the girls the go-ahead to attend the party.

They reportedly met the boy who offered them beer at the party, leading to the sexual encounter.
